砂拉越州议会会议记录及被删除部份

自从过去的十至二十年，州政府拆毁了不少建在黄金地段的政府宿舍。这些黄金地被政府取来批给私人公司。其中，三个片这类的土地被2010年的总稽查司报告关注。我将讲其中的一个案件。

一片位于美里市丹戎罗班的九片土地，面积共约有90英亩或36.44公顷，于1995年被政府批给一间名叫Shoreline Development Sdn. Bhd.的公司。这项批地是为了进行住宅区发展计划。

其中一个条件，就是该公司，Shoreline Development Sdn. Bhd.，需要兴建31间新的政府宿舍来取代被拆毁的28间旧宿舍。该公司已经于2010年7月初将这31间宿舍建成。另一个条件就是该公司必须还给州政府一笔RM2,630,000.00的费用。那就是说RM29,207.55一英亩。

丹戎罗班的黄金地段可值RM2,500,000.00一英亩，不是RM2,630,000.00零吉90英亩。如果该地段以公开招标的方式出售并且以一英亩RM2,500,000.00售出，砂州将获得RM225,113,000.00，而不是区区的RM2,630,000.00。

我尊贵的国阵议员，砂州再这单一的过程损失了RM222,483,000.00的收入。难道你们要说该公司兴建的31间新宿舍值RM222,483,000.00？

议长：议员，你还有两分钟。

到底是谁拥有这一间Shoreline Development Sdn. Bhd.的公司？这间公司是由两间公司共同拥有，那就是Plieran Sdn. Bhd. 及Sarawak Land Sdn. Bhd.
Plieran Sdn. Bhd. 是由KBE (Malaysia) Sdn. Bhd. 全权拥有。
Daya Syukra Sdn. Bhd. 持有KBE (Malaysia) Sdn. Bhd. 60% 的股权。

ALIENATION OF GOVERNMENT QUARTERS LAND

Since past decades of two, the State Government has destructed many of the Government quarters which were built on prime lands. All these prime lands were taken from government quarters use and alienated to private companies.

Amongst all, three cases of alienation of prime land of this kind have been highlighted in Auditor General Report 2010. I will talk about one of these cases. A piece of land located at Tanjung Lobang area Miri comprised in nine lots at the total area of about 90 acres or 36.44 hectares has been alienated to a company named Shoreline Development Sendirian Berhad in year 1995. The said alienation is for the purpose of inter alia development of land into housing estate. One of the conditions of the such alienation was that the said company, Shoreline Sendirian Berhad is required to replace the 28 units of quarters with new 31 unit of quarters, which the company has completed in early July 2010. The other condition of the said alienation was the said company has to pay the State Government premium in the total sum of RM2.63 million or about RM29,207.55 per acre.

A prime land in Tanjung Lobang can easily go to RM2.5 million per acre and not RM2.63 million for about 90 acres. If the said piece of state land is to be alienated by way of open tender or open auction and if it is sold at RM2.5 million per acre, the state will be generating a total revenue of RM225.113 million and not merely RM2.63 million.

My Honorable Members from Barisan Nasional, the State has lost RM222.483 million of revenue in this single exercise. Are you going to say that the 31 quarters replaced by the company is worth RM222.483 million?

Tuan Speaker: Ahli Yang Berhormat, you have two minutes more.

Y.B. Encik Wong King Wei: Yes. Are you going to say it costs the State Government about RM7 million per quarter? Who owns this Shoreline Development Sendirian Berhad? The said companies is jointly owned by two companies in equal shares, namely Plieran Sendirian Berhad and Sarawak Land Sendirian Berhad Plieran Sendirian Berhad is wholly owned by KBE (Malaysia) Sendirian Berhad. Daya Syukra Sdn. Bhd. owns 60 percent of the total share in KBE (Malaysia) Sendirian Berhad.

你是否和我一樣，發覺身邊的親戚和朋友，似乎少了許多。
I wonder you feel the same as me, all the sudden I realized friends and relatives around me seems to get less and less.

以往接近過年時，各種聚餐排得滿滿的，而今年，似乎沒聲沒息。
Those years when the New Year drew near, all sorts of gathering appointments almost completely filled the diaries, but this year seems so quiet.

即使是平常日子，電話少了，與大家見面也少了。
Even in nromal time, phone calls become less and less, face to face meet up also become much less.

也許，大家各忙各的；或者，目前流行 “ 宅生活 ” ，儘量避免出門。
Perhaps, everybody is busy with their own things, or perhaps, nowadays people prefer to stay in.

也不盡然如此。再想一想，很多老友和親戚，已經不在了。嗟！大吉利是，他們都還好好的，只是離開了馬來西亞。
However, it is not entirely like this, thinking further, actually old friends and relatives are not around any more. God bless, they are still alive and well, they just left the country, Malaysia .

去了中國大陸開工廠；王子不做工程師，移民到澳洲開小食檔；阿風離開本地大學，去香港做講師；青蛙去了台灣，開展事業第二春；還有的到了美國、英國，唔，還有去印尼的 …… 。
They have gone to China to set factory; ah Wang quit his engineer job and migrated to Australia to set up his little food store business, ah Fong left the local University went to Hong Kong as a lecturer. 'Frog' went to Taiwan to pursue his second career life. Others went to Americia , England, even Indonesia ...

起初，以為這只是個別現象，逐漸的，旁人也有同樣發現；原來，這不是個別現象，而是社會現象；這不是少數，而是相當大的數目。
At first, I thought these are individual cases, but gradually, people around me realized the same, these are not individual cases but a general symptoms of our society. they are not small numbers but the pretty big indeed.

外交部早前披露了一個數字，說明這個現象是多麼真實，多麼貼近。
Department of Foreign Affairs released the figures earlier, it confirmed the situation is real .

從去年 3 月到今年 9 月，已經有 30 萬大馬人移民他國；其中 20 萬人是今年 1 月到 8 月出走的數目。
From March 2008 thru September 2009, a total of 300,000 Malaysian migrated to other countries, among them 200,000 left between Jan - Aug 2009. (in 8 months)

累積下來，已經有超過 200 萬大馬人移民，接近今天印尼外勞在大馬的人口。
Cummulatively, there are 2 million Malaysian migrated, this figure is close to the number of Indonesian workers in Malaysia today.

不同的是，移居他國的大馬人，多是專業人士、中產階級。
The difference are, those migrated are mostly professional and middle class people.

他們有很多出走的理由，追求事業發展，為了孩子前途，尋找個人更大空間 …… ，概括一句：對馬來西亞失望。
They have many reasons to leave: pursue career development, for the future of their children, in search of better life and environment... In one sentence, they lost hope of Malaysia .

50 年前，大家說，馬來西亞真好，好過香港，甚至日本。
50 years ago people said: Malaysia is very good, better than Hong Kong and even Japan .

30 年前，大家說，馬來西亞還不錯，比得上韓國、台灣（不提香港和日本了）。
30 years ago people said: Malaysia is not bad, comparable to S. Korea and Taiwan . (No mention of Hong Kong and Japan any more).

20 年前，大家說，馬來西亞還可以，至少超越中國、泰國（不能和台、韓比了）。
20 years ago people said: Malaysia can do la, at least better than China and Thailand (Cannot compare with Taiwan and Korea lah)

10 年前，大家說，馬來西亞再差，還不至於像越南、印尼（中國已是不同級別）。
10 years ago poeple said: No matter how bad Malaysia is, cannot be worse than Vietnam and Indonesia ko-ah. ( China is already in a different category).

今日，越南和印尼的經濟成長率遙遙領先大馬，社會活力和知識發展也勝過一籌；距離愈來愈近了。
Today, the economic growth rate of Vietnam and Indonesia already far exceeded Malaysia , Social activity and intellectual development of the country is also better, the gap between us and them is closing up.

怕甚麼，還有菲律賓和柬埔寨、緬甸。
Why worry? there are still Philipines , Cambodia and Myanmar behind us.

但是，一位經濟學家最近到菲律賓考察之後，認為再過 20 年，大馬可以取代菲律賓，出口馬籍女傭到全世界了。
However, according to an economist who recently surveyed Phillipines, he think in 20 years' time, Malaysia can replace Phillipines to become the World exporter of Malaysian maids.

半個世紀以來，馬來西亞是在大宅院裡，用封建方式，分配祖宗家業，消耗社會資源，浪費和逼走人才；不談競爭力，忽略生產力，討厭績效制。
Over half the century, Malaysians live in the big old imperial housing complex, closed up and survive on properties left behind by the ancestor; continue to consume up social resources, wasteful, and drive away talents; they never talk about competitiveness, totally neglect productivity, and hate meritocracy.

亞洲金融風暴來襲時，大馬把門關起來，以為避過一劫，有人還自我陶醉，自以為是天才策略。
When Asia economic storm hit in 1997, Malaysia closed their doors, thinking we beautifully avoided a disaster, there even think of themselves as genius, being able to handle the situation so well.

然而，其它國家面對風暴，走出風暴，進行體質改革，跨步向前，登上另一個水平；大馬卻還在原地踏步。
However, just look at other countries in our neighbourhood, they stand up, face the storm, and walk out of the storm. They overhaul the system, improve the processes and march forward, they moved up to a new level. And Malaysia , still walking on the spot.

馬來西亞，該醒一醒了。

本人诚心邀请您同台辩论有关砂州土地的课题。

本人相信双方的辩论能让人民更了解砂州国阵政府及我党有关土地的立场。

砂州地广人稀，是全国人口稠密度最低的州属。因此我党坚决的立场是砂州地契年限为99年并且地契到期免费、无条件自动更新；“红线”两年后自动取消。

然而贵党所坚持的土地立场一路来都不明确，只是以砂州首席部长的立场为立场。特别是这次诗巫国会选区补选期间，首席部长所公布的新土地更新率，比贵党之前所谓“很便宜”的更新率还要低至少50%。

因此，本人认为一场您我之间的辩论会，有助于人民了解贵党与我党的土地立场，也让贵党可以清楚知道人民所选择的土地政策。

如承蒙您接受此辩论会邀请，本人欣然之至。

Re: Police Report lodged against police brutality at KM85 Jalan Kuching/Sri Aman on 4.6.2010

I refer to abovenamed matter and your press statement in the article entitled “Go to the Police, not the DAP” at front page of “Borneo Post” dated 7.6.2010.

Yang Berhormat said that “From what had been reported” the Complainant “had refused to follow the instructions of the police”.

From the abovementioned article, it can be quite certain that Yang Berhormat possesses information of what was transpired at the scene. The person who informed Yang Berhormat the fact that the complainant “had refused to follow the instruction of the police” must be able to identify who were the policemen appeared at scene and involved in the alleged offence of police brutality.

For Yang Berhormat’s knowledge, the Investigation Officer is currently arranging for the identification parade to be held as the suspect of the case is still unknown to him. In the premises, I believe Yang Berhormat’s information would render assistance to the Investigation Officer in identifying the suspects of the alleged offence. In that case, the identification parade can be dispensed with and the case can be brought to book.

Therefore, as a matter of public duty, I urge Yang Berhormat to provide to the Investigation Officer, Inspector Azlan, who can be contacted at 016-8382007, the identity of the person who gave Yang Berhormat the abovementioned information.

诗巫市议会的车辆失窃案，对警队是个耻辱

诗巫市议会的车辆失窃案，对警队是个耻辱。

大马皇家警察是个没有能力打击罪案的执法部队，警队已经失去效率，失去人民的信心。

诗巫市议会的车辆失窃，就算该市议会人员已经去警察局报案，到后来还是靠报案者用GPS寻回车辆。整个警队的效率还比一个市民还还来得差劲。这显示人民无法依赖警队来保护我们的性命和财产。

警方已经对罪案麻木。特别是偷窃，抢劫，恐吓等罪案，警察总是说他们无能为力。

如果一个警队不能捉拿罪犯归案，这警队是可有可无，是在浪费纳税人的钱来供养这些警员。

这是整个警队的心态问题，政府重来没有想过重振警队，而任凭警队继续腐败及懒散。难道这就是国阵政府所承诺的，安稳及繁荣吗？

今年3月初，古晋市民曾经见识过警方高素质地为国阵土保党大会执行任务，几乎古晋地区各个角落都有警察人员在巡逻及在交通灯叉口站岗。

对于土保党，警方就总动员工作，对于罪案，警方就束手无策。这是叫人不能接受的工作态度。

我们, 古晋民主行动党社会主义青年团(社青团)，强烈要求警方在古晋人潮多及罪案率高的地区每日巡逻及站岗。

2010年3月初，古晋市民在国阵土保党常年党员代表大会举行期间见识过警方高素质地为土保党执行任务，几乎古晋地区各个角落都有警察人员在巡逻及在交通灯叉口站岗。

因此，我们强烈要求同样的警力惠及全体古晋人民，像对待土保党一样。古晋罪案猖獗，纵然官方数字不会这样显示。最近我们有四个女学生遭匪徒攫夺财务，有一个甚至牺牲了她的性命；也有一个德士司机遭谋杀；学校之外的暴徒也进入学校内殴打学生；从没停止过的住家及商店爆窃；车辆失窃；强奸等等。古晋市被国阵政府描绘成安全的都市，然而许多古晋市民肯定不会赞成这样的形容。

我们也曾收过一些住家遭爆窃受害者的投诉，说，当他们致电警察部门投报案件的发生时，他们竟被警方要求去到最近的警察局书面投报后，警方才会派警察到案发现场调查。警方给的原因是他们不可擅自离开办公室展开案件的调查除非有正式的投报。

就因为这样，那些受害者需要等上大约两个小时来向警方投报及录取口供，之后再等上几个小时查案警员才抵达案发现场。最终，涉案的罪犯早已逃之夭夭。

但是，反观，雪兰莪州警察却可以自动自发报警，投诉民主行动党秘书长兼槟城州首席部长涉及煽动行为。

如果警方可以这样自动自发对付国阵的政敌，那就是民主行动党，为什么不能同样对待人民的公敌，那就是无法无天的匪徒？

我们要求公平及尽责的警察执法。我们要求贴近人民的警察部队。这样才能防范罪案的发生，才能使警员成为第一个到罪案现场提供支援的人员。一个很大的原因为什么罪案不断卷土重来，那就是警察往往都是在罪案发生后许久才出现。

我们发现警员对那些触犯了小小交通规则的司机及摩多骑士比较注意，例如对那些越过双白线的司机；那些没有使用免手提通用电话的司机；不合法泊车；路税或驾驶执照逾期者，等等。这些其实是交通警察，交通局执法组及市政局交通人员的主要工作，不是警察。

我们好奇的是，一个触犯了小小交通规则的司机，瞬间就经过某个地方，对于这样的人，警方往往有办法截停他们；但是一个匪徒，在某个地方待上几句钟甚至几个小时干案，对于这样的人，警方往往没有办法缉拿他们归案。

因此，我们要求警方把警力集中在打击罪犯，透过在古晋人潮多及罪案率高的地区每日巡逻及站岗。而且这是香港及韩国警方一直都在进行的。

为了人民的利益着想，我们希望我们的要求能获得警方的认真考虑并且获得同意。

Dear Sir,

Re: Call for daily policemen patrolling and stand guard at crowded place and places with high crime rate in Kuching.

We, Democratic Action Party Socialist Youth (DAPSY), Kuching, strongly call for daily policemen patrolling and stand guard at crowded place and places with high crime rate in Kuching.

The people in City of Kuching have experienced a great job done by the police personnel in patrolling and stand guard at most of the traffic light junctions all over Kuching City during the Annual General Meeting of Party Persaka Bumiputera Bersatu (PBB), Sarawak, a component and leading party of Barisan Nasional in Sarawak, on early March 2010.

As such, we strongly call for equal force from the police, as what has been provided to PBB, to the benefit of all the people in Kuching. The crimes in this city are rampant, although the official statistics may not show so. Recently, we have four students being robbed where one of them was killed, a taxi driver was murdered, outsiders went into a secondary school and blashed up a student, non-stop houses/shop breaking incidences, theft of vehicles, rape cases and others. The City of Kuching was painted by the Barisan Nasional Government as a peaceful city to which most of the people of this city will strongly disagree.

We have received complaints from some of the victims of housebreaking that when they made phone calls to your department to report the incident of housebreaking, they have been asked by policeman to lodge a written police report at the nearest police station before any police personnel can go to the crime scene. The reason given by the police was that the investigating officer has no authorities to go out from their office to carry out investigation work unless they are referred to a formal police report.

As a result of which, the victims have to wait for about 2 hours to lodge a police report and to record his statement; and wait for another few hours for an investigating officer to come to the scene for investigation. At the end of the day, the criminals are, most of the time, untraceable.

However, on the other hand, the Selangor Police can by their own initiative lodged a police report against DAP Secretary-General and Penang Chief Minister, Lim Guan Eng, for sedition.

If that can be done against DAP, a political enemy of Barisan National, why it cannot be done against the criminals, the common enemy of the people?

We urge for fair and responsible enforcement from the police force. We urge the police to be more to the ground and more accessible to the people for the purpose of preventing the crime and to be the very first person comes to the crime scene when victim is calling for aid. One of the main reasons why crimes are rampantly repeating is because policemen were only arrived to the scene long after the crime has happened.

We noticed that policemen are keener to pay attention to drivers or motorcyclists for minor traffic offences, such as vehicles which cross double lines, drivers who use handphone without hands-free while driving, illegal parking, vehicles or drivers with road tax or driving licence expired, etc… These are duties supposed to be carried out by traffic policemen, enforcement team of Jabatan Pengangkutan Jalanraya (JPJ) and traffic wardens of local councils.

We are curious why, to a minor traffic offender, who passes by a particular place in seconds, the policeman is able to identify and stops him; however to a criminal, who commits a crime in a particular place for minutes and hours, the policeman is unable to arrest him.

Therefore we call for your department to concentrate your man power in fighting against criminals by daily patrolling and stand guard at crowded place and places with high crime rate in Kuching. This has been doing by the policeman in Hong Kong and South Korea.

In the interest of the People, we hope our plea herein will meet with your serious consideration and approval.

On 24.9.2004,policeman seized the pocket money in total sum of RM5,980.00 from 3 suspects before put them in lockup. The money was never returned to them since Sept 2004. All these years the police kept ignoring our letters until we filed a application to Court pray for the money to be produced to Court and to be returned to the respective owners. Finally, after more than 5 years, the police brought the money to Court and returned it to the owners. They shd returned the money to the suspects when they were released 5 years back as there is no reason why the pocket money should be detained. Shdn't the police be the guardian of our safety and property?

Satu lagi Projek Cakap Barisan Nasional, 石角大桥几时扩建？

这是2009年8月8日剪报，当时杨昆贤在该报导中指张君光大桥预计在一两个月内动工。

我要质问联邦政府为何迟迟还未扩建石角张君光大桥，是否因为联邦政府国库虚空，已经没有拨款。

我今日前往石角大桥，发现该处并没有如工程部副部长拿督杨昆贤之前所承诺的已经动工。联邦政府工程部在2009年8月7日向人民承诺该石角大桥扩建工程即将在一两个月内动工，将从双车道扩建至4条车道。而且工程将会在动工后18个月后竣工。国阵政府向人民许下的诺言并没有履行。

距离去年8月所做的承诺，到如今已经快半年了，但是我们依然没有看见有任何动静。人民依然处在塞车之苦。这是其中一个例子证明国阵政府的无能。国家在国阵政府管辖下，已经十分贫穷。

贪污是我国现在许多问题的根源，如果首相有决心要彻底肃贪，国家肯定更加富有。民主行动党的槟城政府是严打贪污的州政府，可以看到该州在经济上有明显的进步。槟城政府成功让其财务转亏为盈，不但填补了2009年预算案中的4000万令吉赤字，更获得盈余7730万令吉。

国家富有，人民才会富有。国阵政府现在连建设基本设施都有问题，证明了他们没有良好施政，没有决心肃贪。

我也质疑是否石角大桥的扩建工程遭受搁置，是为了等待下次的州选到来时，再拿来成为国阵的竞选筹码？这是国阵政府一贯的肮脏伎俩。

“一个马来西亚”是什么意思？

哲学家会说：“这是一个十分有深度的，因为它简单得又不容易明白。”

天文学家会说：“在浩瀚的宇宙，有一个太阳系，太阳系里有一个地球，地球上有一个马来西亚。”

生物学家会说：“虽然我们可以复制羊，牛，甚至人，我们不能多复制一个马来西亚。”

地理学家会说：“一个马来西亚，是在一个新加坡的北部，也是在一个泰国的南部。”

数学家会说：“对了，一个马来西亚，就是一个马来西亚，不可能会是两个”

国阵马屁精会说：“你看不出是什么吧？这就证明首相有远见。”

马来西亚百姓：“？？？”

自从首相就任，提出“一个马来西亚”口号，至今还只是一个口号。首相7月31日刚推出的“一个马来西亚”信托基金，依旧有种族固打。这是很大的讽刺，难道首相要塑造一个到处有固打制的马来西亚？要人民了解什么是“一个马来西亚”的施政方针，言行一致是必须的，单单口号是不够的。

赵明福事件已经把国阵的反贪假面具扯了下来。原来反贪污局所谓积极调查巴生港口和基尔的2,400万的豪宅是假的，怎样都不会查国阵官员像查问赵明福到三更半夜吧？与赵明福同一天被召问话的加影市议员陈文华被反贪污官员以暴力，恐吓及种族性言论辱骂。很有可能对赵明福的盘问方式也是如此。陈文华被辱骂为“一个愚蠢华人”。如果这是所谓“一个马来西亚”的施政方针，那么这口号应该改为“一个黑色马来西亚”更为恰当。

贪污是众多施政偏差的根源。新首相政府仍然没有展示扑灭贪污的决心。砂州国阵方面更是照一贯的作风，官官相护，一起“发财”。砂州政府没有实施所有政府工程公开投标的决心，继续黑箱作业，又是“一个黑色马来西亚”。

再来，根据2009年反贪污委员会法令第23条文阐明，“任何公共机构的官员，利用自己的职位或地位，获取任何利益给予自己，或亲属或朋党，都属于贪污。”如果这些作风没有铲除，也是“一个黑色马来西亚”的局面。

“一个马来西亚”到底是什么意思，至今还没有解释清楚。

行动党破纪录　美食节130选民注册

(本报古晋11日讯)砂行动党极力为市民提供“新选民登记”之服务﹐并在上周六在古晋美食节突破记录﹐收集了130份选民登记资料。
　　砂行动党国州议员张健仁之特别助理黄庆伟于今午的媒体发布会上表示﹐该党于8月8日晚上，在古晋民众会堂为市民处理选民登记﹐但却遭南市执法部向他发出一张传票﹐罪名指他在没有向市议会申请准证的情况下﹐在古晋民众会堂范围里展示“新选民登记”的告示牌﹐因而罚款马币200令吉。
　　传票内也显示﹐受罚者必需在期限内﹐即8月17日缴清有关罚款。
　　他补充﹐此项条例是根据南市(广告)条例2003年第3条文﹐若受罚者不缴交罚款，将把问题带上法庭﹐罚款最高为2000令吉或监禁6个月。
　　黄庆伟诉说当晚的情况时指出﹐当行动党党员在民众会堂进行新选民登记时﹐大约有10多名南市执法部队站立在旁约有30分钟﹐之后﹐才要求该党收起告示牌﹐否则将触犯南市的条例。

执法部队有心针对

　　他表示﹐从南市执法部队的举动可看出﹐该些官员是存心针对行动党﹐因为他们是在新选民登记处徘徊了许久后﹐才想到援引何种法令来对付行动党。
　　“而且有关南市执法部的领队，除了要求我们收起新选民登记告示外﹐还警告我，不要占他们(南市)的便宜。当时﹐我并不清楚﹐我们占了南市什么便宜？我们只是为市民进行选民登记。”
　　黄庆伟也说﹐南市于上周阻止行动党在民众会堂摆设摊口﹐而开出传单予张健仁﹐所以该党改用以举牌方式﹐但却又处处遭到阻扰。但是﹐他清楚知道的是﹐砂州国阵政府一直透过地方议会来占人民的便宜。
　　他举例说明﹐垃圾私营化就是一项很明显的例子。他续说﹐以前﹐地方议会每年只需花费50万令吉作为垃圾回收费用﹐但自垃圾私营化后﹐南市单缴付给私营化公司的开销﹐每年大约300万令吉。不仅如此﹐垃圾回收的次数不但减少﹐服务态度也变差。
　　他表示﹐缴交传单会让他心有不甘﹐在这情况下﹐他将会与该党领袖﹐以及行动党律师团成员商讨此事﹐以作出解决方案。
　　“目前﹐我未做任何决定﹐而且缴付罚款的期限也还没到。”

MBKS and DAP war over voters registration counter continues

Wong King Wei, Personal Assistant to MP for Kuching, Chong Chieng Jen received a summon last Saturday night from the Kuching city south for ‘exhibit depiting new voters registration without valid licence/permit from the council.
Wong said this afternoon that he was disappointed with the council’s enforcement unit’s attitude as before giving him the summon, they had stood around for half an hour deciding what to do with him and the DAP members for helping registering young voters.
The enforcement head of MBKS said, “Dont take advantage of us” before giving the summon. He said it appeared that the MBKS were adament on giving them a hard time.
Wong said it was the MBKS who had been taking advantage of the people all these while. He said before the rubbish collection was privatised, the council coolection was RM500,000 per year. After Trienken took over, he said, collection of rubbish which was only 2 times per week(previously 3 times), the payment was RM3 million per year.
He said the week before Chong also received a summon for littering when they were registering young voters.
Wong said he was undecided whether to pay the compound fee or not as the due date for compound is on August 17. He said he would discuss the matter further State Chairman, Wong Ho Lien and Chong Chieng Jen.

石角巴罗桥失修

石角西里益中公A路尾端的巴罗桥已埙坏多年，让居住附近的村民每天都得战战兢兢的使用该木桥。行动党石角支部党员探访附近的村民之后发现该木桥自从1986年被使用至今，政府从未投入修补该桥的工作。村民们在1999年至2007年期间曾多次请求透过拿督叶金来和人联党思故邦分部执委请求当时的联邦工程部政务次长拿督杨昆贤向政府申请建造新桥以惠及当地村民。而至今却有如石沉大海，全无下文。政府不应等到意外发生时才来做补救，而是应该以人民的安全和利益为重。政府这种不负责任的态度已严重影响当地村民的日常生活，因为该桥是他们通往外界的唯一要道。
人联党每次的大选口号都离不开以政府拨款来捞取选票，但是人民却无法享有最基本的设施。巴达旺市议会主席陈如飞说议会不够拨款供兴建基本设施。我要问的是，为什么州政府却有钱兴建3亿的新立法议会大厦？
身为执政党的人联党，都无法协助自己选区的村民建造一条桥梁，真是一大讽刺。所谓人联党一向来都强调的“有人在朝好办事”，原来是虚构的。

请人联青不要再谩骂，请回答政策问题

人联党在上届州选后失去六个州议席后，曾经不断表明将进行改革。人联党所谓的改革是只见楼梯响不见人下来。这届的州议会已经过了一半的任期，还不见人联党在土地政策上有任何改变。行动党在州议会提呈土地修改法令，要将现有的不公平的土地政策修改，给人民更好的土地保障，这包括地契免费自动更新及红线两年自动解除。人联党却不敢面对人民的诉求，在动议这法案时选择逃避。也因此创造了我国有史以来第一次集体离席州议会事件。这导致了这法案“流产”。

对于这起事件人联青至今仍采取谩骂的态度，尝试丑化行动党的议员。但是州议会是讨论人民的事。人联青如果要接过未来执政的棒子，应该发表政策上的意见。因此我想请问人联青几个个关于土地政策的问题：-
1. 砂地广人稀，但是许多地主频频面对地契更新费高得惊人。请问这合理吗？
2. 如果将法令改成地契到期免费自动更新99年，这好不好？
3. 土地法典第47条文赋予州政府权利可以将土地画上红线几十年，无需真正使用或赔偿，请问这合理吗？
4. 如果将法令改成红线过了两年自动取消，这好不好？
5. 现今的政策是，土地遭政府征用，所获得赔偿是土地遭画红线时的市价。如果有地主是在红线后几十年才获得赔偿，不过又是获得几十年前市价的赔偿，这合理吗？
6. 如果将法令改成红线两年内必须宣布赔偿数额，之后的3个月内必须付还赔偿，这好不好？

砂国阵又赶行动党州议员出州议会

国阵屡次将行动党议员逐出州议会，显示政府没有决心解决人民的民怨。这届的州议会，国阵首先先对行动党州主席黄和联下禁足令长达12个月，之后将温利山州议员逐出州议会一天，现在又再次威胁以特权委员会对付张健仁州议员，这是鸵鸟心态，为了逃避面对人民的诉求。

议会殿堂讨论的是人民的事情。国阵将行动党议员逐出议会能够解决自己怨气，但是不能解决人民的怨气。行动党在州议会是批评政府的不公政策，不是为了惹议员们的怒气。黄和联在辩论附加法案，为了争取更透明的政府财政账目而被政府禁足议会一年。张健仁及温利山在提呈一个更利于人民的土地改革法典及提出治水计划而遭到对付。如今，人联党要在次将张健仁交予特权委员会，因为提出甘密街巴刹被关闭事件。

这种种的对付行动是有计划性的，目的是要逃避人民的诉求。国阵及人联党如果是以身为“父母官”的心态来参政，就不应该只顾着解决自己被人批评的怨气，而罔顾人民的怨气。

Introducing the Land Law Reform (Renewal of Terms and Documents of Titles and Acquistion) Ordinance 2009 Bill

Assemblyman for Sentosa, Chong Chieng Jen submitted a Notice of Motion pursuant to Standing Order 45 today, first time an opposition party has done so in DUN.

In the notice of motion made available to the press today, it stated “Whereas under the existing Section 26 of the Land Code (cap 81) upon expiration of the term secured under a document of title to land, the person claiming thereunder has no guaranteed right of renewal of the term.

And Whereas this has created great uncertainty, anxiety and concern amongst landowners throughout the State of Sarawak whose terms of documents of title will expire within the next 20 years.

And whereas the premiums imposed by the Government on renewal of terms of documents of title are excessive and many landowners find them burdensome and unaffordable.

And Whereas the provision under the Land Code (cap 81) in respect of Resumption of Alienation land are unfair, in particular, the ooperation of Section 47 thereof in the asessment of the compensation amount and the delays in the payment of compensation amount for land resumed by the government.

wherefore:
for the better protection of the rights of landowerns in the state of Sarawak. It is hereby moved that leave be granted by this house to the Member for kota Sentosa to introduce the Bill entitled “an ordinace to provide far automatic renewal of terms of documents of title to land an a fair process of compulsory acquisition of land, the assessment of compensation to be made on account of such acquistion and other matters incidental thereto”. The short title of the Bill shall be “Land Law Reform (Renewal of Terms and Documents of Titles and Acquistion) Ordinance 2009.

With the passing of t his Bill, it will solve the predicament of the landowner of Sarawak. The Bill will repeal part of the Land Code (CAp 81) in so far as relating to renewal of terms of documents of title and resumption of alienated land. the leading features of this Bill are:

1. It provides for automatic renewal of terms of documents of title to land without any payment of premium.
2. It provides that the notice issued under Section 47(1) of the Land Code (Cap 81) shall lapse and cease to be of effect on the expiry of two years after the date of the notice in so far as it related to any land or part thereof in respect of which the government has not acquired within the said period of two years and
3. It provides for prompt payment of reasonalble compensation amount for land resumed by the government.

Summonse flying around cause for concern, DAP

Mechanic, Henry Goh approached the DAP for assistance yesterday which he felt he and his wife were wrongly issued summons on December 3 last year at Tunku Abdul Rahman at 8.55 pm and March 23 last year at 7.07 pm at Green Road.

Wong King Wei, Special Assistant to MP for Kuching, Chong Chieng Jen said he received the december summon recently by post and even though he was sure his wife, Lo Siew Lee (the car under her name) never go out at night, he decided to pay the summon as it was RM30.

Yesterday morning, while at the police station, he was shocked when he was told that there was another unpaid summon in March.

Goh said he decided not to pay both summons and asked the DAP for help. He said he would not know if the police would issue him more summons without his knowledge.

Wong said his legal firm had decided to help Goh and would take out the case. He said it was up to the police to prove that the car was there both times. He said he was worried that the summon could be posted with malice.

7 Summons of Jalan Court House cancelled by JPJ

The Road Transport department has issued a letter to Wong King Wei, Special assistant to MP for Kuching Chong Chieng Jen to allow seven car owners to have their summon cancel and instead be given a warning.

Talking to reporters yesterday, Wong said he was approached by seven car owners who had parked their vehicles along Jalan Court House on February 17 this year. The car owners were customers and business owners in the area.

Wong wrote a letter to the Director of RTD on February 18 asking the department to cancel the summon as he felt that the said road was closed for construction purposes and there was no through road in the area.

He said since the closure of the road on April 1 last year, the businessmen in the area complained that their business had dropped by 50%. Wong said due to that, even with the closed road, the RTD still wanted to issue summon to the people.

Wong said after the RTD replied, he hoped that the road would be reopened as construction work on the building had stopped for a while. He said the road belonged to the people and to close the road is not only affecting the business of the people there but also affecting the smooth flow of the traffic.

Despite him bringing the matter to the Land and Survey two weeks ago, Wong said he had yet to receive any reply from them.

The Federal Court pronounced the judgment for Bandar Kuching Election Petition today in Kuching. Chong Chieng Jen won the case.

Chong described this case is a “joke” and glad that it ends finally.

SUPP had started all these. This shows that they are not respecting the mandate of the people. Chong won a handsome majority of 9,952 votes. I wondering why SUPP still has any queries of what is in Kuching people's mind. Isn't it the result in 308 tells that vividly?

What was right is right, what was wrong remains wrong. We are taking steps to lodge police report on those who have being ruled of making false sworn statements in the Court. This is to ensure that the society will move to the direction of righteousness. Wrongdoers should pay their costs for doing wrongs.

308一周年

308一周年，
民意愈来愈抬头，达至建国以来最高境界。
人民对贪污，滥权，腐败，官僚，朋党，种族主义等名词，更加了解。
这是对国阵的一个警钟，也是对民联一个督促，督促我们要做的更好。

人联党总是说火箭只说不做。
308过后，我们证明了火箭成了政府后，做的让国阵望尘莫及，就是说没得好比。
之后国阵甚至纷纷效法，特别是向槟城火箭政府学习。

虽然民意抬头，但是民主政治工作者面对的是更严峻的挑战。
我们面对更加艰巨及危险的工作环境，风险更大了。
但是我相信雨后会有彩虹，
只要民众对原则，社会公义，民主更加追求及永不妥协，
国家将有更美的未来。

有“月饼”，没“西瓜”的国阵

国阵以为有了“月饼”就万事足，就能夺回霹雳政权，
不过却没想到，没有“西瓜”是个大错。

还好我们还有“西瓜”，给国阵一个错手不及。
所谓种瓜得瓜，种“饼”让你变“猪头丙”。

现在霹雳的宪法危机，是国阵一手造成。
被人民唾弃的国阵无法在霹雳形成“政改”热潮。
霹雳变天其实不是改变，而是打回原形，打回到人民不想回到的原形。

霹雳议长对国阵大臣及行政议员的禁足令，
是为国家大义否决国阵对民主所施强暴行为。

国阵称民联恋权。这是“傻瓜”的话。
民联要求的是解散州议会，进行选举，还政于民。
是国阵恋权，不敢选举，抹杀民主，霸王硬上弓！

傻瓜形成，是因为没有政治理想、抱负的人参政。
从政者只为私利，是人民的悲哀。

西瓜，冬瓜，苦瓜，大南瓜都好，别做傻瓜。

模仿ICAC的模式，没有模仿心志

我对新的反贪污委员会对雪州州务大臣的积极调查行动感到惊讶。（阅读今日大马新闻）
对民联的部长，他们总是特别积极。
这是改革后的反贪委员会的唯一新形象。

反贪污委员会（前身是反贪污局）是2009年1月1日起进行“锐变”，
其实是名字上的改变，人事上完全没变，所以百姓“没便”。
改变没有来到反贪机制，阿都拉卸任前只不过把名字换一换。
如果反贪的决心没变，什么新的法令，新的名字，都不过是花拳绣腿。

对雪州大臣的积极态度，是好事，
因为这样能够透过法庭来寻求真相，
当然如果反贪委员会“玩臭”就不是好事。

尤其现在民联的议员及行政议员纷纷中招，
先有安华被控鸡奸，霹雳两位行政议员被控贪污（之后跳槽），
郭素沁在内安法令下被关7天，
吉打一名州议员因不堪受献议跳槽而辞职，
黄洁冰被公开裸照，
什么把戏都有。

马来西亚模仿香港的廉政公署（ICAC）的模式，没模仿心志。
反贪委员会是选择性采取行动，不顺眼者斩。
我们有“挑食”的反贪机构，国家就不健康。

日前砂反贪污委员会主席，礼貌拜会我们砂首长，
不知她有否告诉首长先生他们将采取严厉行动铲除砂州贪污滥权问题呢？

我对回教国、回教法的立场

1. 回教党在瓜拉登嘉努补选流失大量的华裔选票，是自食其果。回教党提出建立回教国议程是在“玩火”，在考验华裔选民的耐心，也在考验我党的容忍度。故此，我支持全国党主席卡巴星坚决反对建立回教国立场。

2. 我党是全国唯一反对建立回教国、坚持世俗国的政党。人联党对前首相敦马哈迪和现任副首相纳吉所提出的“回教国”，及现任首相拿督斯里阿都拉所提出的“世俗回教国”都默许，是华人执政党的一个耻辱，是最没有原则的政党。

3. 308过后我党看到人民求变的心，一心一意要粉碎国阵的霸权及贪污，于是在西马与公正党及回教党合作组成民联。催促我党参与民联主要的原因是为国、为民缔造更好的生活环境，并不表示我党因此认同盟友的每一项政治议程

4. 民联与国阵的联盟是十分不同。（一）民联不是一个组织，是一个合作关系的称号。民联没有内部宪法，因此“回教国”议程不是民联三党的共同议程。（二）民联三党的合作是互相制衡，产生三党之间合作同时的政治张力，与人联党在国阵里“寻求协商”的地位，有很大的区别。也因为三党互相依赖的合作关系，回教党不能在没有盟友的支持下，进行“回教国议程”。故此，我再次支持全国党主席卡巴星的立场：宁可不执政，也不同意建立回教国

5. 至今人民公正党仍对“回教国”议题持模拟两可的立场。吁请公正党实权领袖拿督斯里安华表明其党对“建立回教国”所持的立场，以展示在砂州与我党合作的诚意。

才吃完了午餐，我在办公室内，争取时间弄一些文件。
因为两点有约，需要到服务所去。这时大约刚过下午1时。

在晋中求学时，这段时间是与两个死党一起走路回家。
我们总有聊不完的话题，聊课业，聊同学，聊老师，聊补习，当然也聊女生。
那时每个星期五的这个时候，与一班基督徒同学及老师，在一间很陈旧的科学实验室聚会。
一起唱诗歌，一起祷告，一起听道。那是学生团契。

在隔壁的教师及行政室，也是很陈旧的木板建筑物。
那里有我被老师及校长骂的经历，记忆犹新。

可能也是记忆犹新的关系，当我看到这两栋建筑物被大火吞噬的那一刹那，
泪水总爱在我眼眶徘徊。

我大约1时15分听到我的同事告知“你的母校着火了”。
我即刻半跑快步到晋中。
我到的时候，科学实验室正在着火，火势也刚蔓延到行政楼。
还来得及见到科学实验室最后一面。我拿起手机拍下了以上的“遗照”。

98年离校至今，整整十年。旧同学们一直都有一个心愿要回到母校拜访。
但现在学校保安森严。
才1个月前，我们的聚餐也提过，甚至问起参与校友会一事。
也在那时候，我原本有一个机会，借着公事可以拜访母校，但之后也告吹。
十年后返校，竟是这样的场合。

科学实验室及行政楼化成灰烬。
留在记忆的是往事，留在眼前的是未来。
政府不要在重建晋中校舍上唇上口花花，行动慢吞吞。

在过去镇中火灾一事上，我们已经领教过国阵这样的作风。
这导致影响新生的入学。
我们也受够了。

Judgment for Malaysian

We won the case against JPJ yesterday in High Court Kuching. It is about a car owner, Leonard Lim, who was refused his right to renew his road tax for his Kenari, the reason given by JPJ was that he has a outstanding summons on a different vehicle (a lorry)to which he was the driver.

In his affidavit, Leonard avered that he was issued the summons because he refused to bribe the policeman. The policeman accused him, in the summons, for being carrying dangerous loads. However， strangly, the policeman, when stopped him, mentioned nothing on the dangerous loads, but merely asked him "Apa macam sekarang?".

He ignored the summons. Thereafter he discovered that he has been balcklisted by JPJ only when he went to renew the road tax of his personal Kenari.The funny thing is that, the summons issued on 5.1.2007 stated that the offence "was committed" on 5.12.2007, it is a future offence.

Leonard Lim wrote to the police asked to cancel the invalid summons. No reply from the police. He then came to see Chieng Jen and Chieng Jen wrote to JPJ asked to allow him to renew his road tax upon payment of the prescribed fee. JPJ had, in reply, refused to do so.

Leonard Lim brought an action of Judicial Review against the Director of JPJ and Licenced Registrar.

High Court ruled in favour of Leonard, stating that a person is innocent until proven guilty. A summons is merely an allegation for offence. JPJ's act in refusing the renewal of road tax is unreasonable and unlawful. It is forcing someone to plead guilty. Further it amounts to violation of Art 13 of Federal Constitution, depriving one's right for the usage of property.

Leonard's claim to the damages consequential to the act of refusal to renew the road tax was allowed. The quantum of damages is to be assessed by the Deputy Registrar. JPJ is liable to pay the cost as well.

It is a victory to all the Malaysian. Over decades we have been suppressed by JPJ force to pay the fine of all the outstanding summons before the road tax of whichever vehicle you owned can be renewed. The High Court Judge pronounced the illegality and unreasonablness of JPJ's act. It is infringing human rights. JPJ have alter their system accordingly. Please stop violating our rights.

国阵不能见人，所以怕了健仁

今天开始了砂州立法议会，这次健仁无法出席，因为在今年五月的立法议会，他成为2007年州立法议会特权及权利法令的第一位受害者。国阵以人多欺人少的方式，将他禁足与立法议会之外。

我们几位党员今天大清早到州立法议会的大门，声援张健仁。我们一行人在议员部长们的入口处拉起布条，将声音传达给国阵议员知道。国阵后座议员主席，阿都卡林甚至还停下车拿起手机将我们拍下来。我对他说：“YB，记得将照片放上你的部落格。”他也笑着点点头。

我今天谴责国阵将议会变成政治逼害的场所，灭绝异议之声。代议士是人民选出，岂可容你们禁止他在议会里发言。这是在消灭言论自由，何来民主？

张健仁身兼国会及州议员。国阵透过古晋选举诉讼案来推翻他国会议员的资格，也透过州议会的法令来阻止他好好履行州议员的责任，这可是双面夹攻，非要置他于死地不可。

将健仁禁足的动议可是人联党主席陈康南附议的。人联党注重于个人权利的斗争，过于人民权益的斗争。在国阵里不敢为人民争取权益。自己不敢，又不肯别人讲。人联党不值得人民再委托。

我们今天布条的字眼是“国阵不能见人，所以怕了健仁”。许多国阵的部长及议员开会之前都须看看我们的布条，包括陈康南，阿旺登雅，邓伦奇，李景胜等人的座驾都与我们的布条相遇。

精力过剩的老人家

林良实说出一句耐人寻味的话：不只是政治人物，很多高高在上的男人都有精力过剩的问题，所以他们必须寻求管道发泄多余的精力。

他是在为蔡细历辩护时说出这一番话。这老林可真是了解老蔡。

政治人物必须不止是个人能力的佼佼者，更加是个人品格的佼佼者。为什么？如果他们给予错误的品格示范及信息，这将是社会问题衍生的一大根源。社会问题也是国家领袖必须去处理的事。社会如果生病了，领导者怎能说他有美好的政绩？

这些人在辩论国会女议员的穿着，马航亚航空姐的制服，公园里不可牵手等等，但是对自己或同伴们搞婚外情视若无睹，可以包容

国阵领袖对自己宽容，对百姓苛刻，可以到了这种地步。对自己总有百般的借口，对别人总是百般的压制。同样的，国家工程给自己朋党或家人时，总有百般借口。说什么“家人公司生意好，不是我给的，是他们够努力”。国家经济好处分不到给百姓不打紧，还要继续压制。起个油价，让我们喘不过气。

无论是高高在上还是低低在下的男人，都不可随意发泄精力。没有人有特权越过道德标准。天子犯法与庶民同罪。老林的一番话实在难以接受。难道这是国阵里的传统？

我们砂州高高在上的老人家，有没有精力过剩，随意发泄的问题？

伯拉，你可别后悔！

伯拉将来会像老马一样后悔选错接班人吗?我替伯拉担心。退休的老人家，真的不该留下遗憾，免得陷入终日思想遗憾的黄昏岁月，是人生一大悲哀。

林吉祥今日刚刚在国会要求政府设立皇家调查委员会，对即将在明年3月上任成为我国首脑的纳吉。纳吉受到许多丑闻缠身，包括蒙古女郎炸尸案、潜水艇军购案、直升机军购案等等。这些都是悬而未解的案件。换一句话说，纳吉还没被证实他是与这些丑闻毫无关系。

请还纳吉清白！请还我国未来首相清白！
伯拉，只要你点头，将纳吉交给皇家调查委员会调查，他就有获得清白的一天。这一天必须在纳吉上任之前。纳吉不是你为自己挑选的继承人，他可是你为我们挑选的未来一国之首，千万不可敷衍了事。

真金不怕红炉火，炼过方可成首相。

我替伯拉你担忧，怕将来如果，万一，一个不小心，你的继承人出了什么事，你会加入敦马创立的“后悔首相俱乐部”。到时他对你说他的后悔，你又对他说你的后悔，不是极大讽刺吗？

敦马用马来西亚宝贵的5年来试验他的决定是否正确，你可别随意拿国家的青春再来试验。这可能是我们的大半辈子。

马来西亚还有希望吗?

我在想马来西亚还有希望吗？首相的将要下台及前掌管法律事物部长，再益，的下台，似乎都在说明国阵的改革无望。不同的是，首相是大势已去而决定近期内下台，再益是为了原则及失望下台。

2004年上台的伯拉，踌躇满志，一心要改革。但是在国阵没有提供一个平台满足他的改革欲望。所以逐渐暴露了他弱势。一国之首成为没有掌握实权的领袖。这是马来西亚的悲哀。马来西亚有过强势的领袖，却没有内涵；如今有雄心的领袖，却是弱势。下一个首相是属于那一种呢？相信你我心中已经有一个谱。

我们要廉洁的政府。曾听说有虔诚的回教徒十分向往去槟城投资。槟城是没有实施新经济政策，打的是绩效制招牌。那些回教徒在槟城没有优先。但是他们却向往廉洁的政府来投资，这也是他们的回教教义。

无论马来人，华人，印度人，或其它原住民，我们要一个属于我们的马来西亚。没有人是寄居的。没有那一个种族享有优先权。建国几十年来，这些都在退步。我们离目标越来越远了。

马来西亚还有希望吗？我觉得有，不过不在国阵里面。

康南现在很难

砂副首长陈康南有如被首席部长泰益玛目及州部长阿旺登雅，一人刮一巴，一人左边，一人右边。
现在的康南可能双颊都热辣辣的。

诗巫的地主现在面临昂贵土地更新费的问题。“星洲日报”有记者评论说，没地难，有地也难。我十分同意他的说法。国阵政府都是要我们活在两难之间，两难里择其一。到后来大赢家还不是政府。

人民现在很困难，没汽车难，有汽车也难。不反对政府难，反对也难（ISA就来了）。

陈康南现在很难，很难在内阁里说话。他日前反驳阿旺登雅说土地更新费不是没得商量。他说要把土地的更新费带去10月9日的内阁会议讨论。

10月9日还没到，首席部长就出来发言了。首席部长把陈康南拒在千里之外，说更新费没得降。还没谈就没得谈。真的是给人刮了左脸，又右脸。惨哉！

陈康南很难，靠人联党更难。

We Won!

We won in Bandar Kuching Election Petition. What a wonderful day!

The High Court Judge, Datuk Clement Skinner read out the Judgment in open court, and it took about 1 hour and 45 minutes for reading the 54 pages Judgment.

The grounds of judgment were solid and thorough in alomst every aspect of the issues of the Petition.

At the end of the Judgment being read, the public gallery was full of joy and started clapping hands, regardless the Court is still in sessions.

It shows the Court's decision is in concurrent with the mandate of the people at large in the election held in 308, and there was no undue influence and bribery conduct committed by us.

A large number of members of DAP turned out to the Court, and the Court was packed with even no much of space to stand. I love the crowd so much. So do the supports and the concerns from the supporters from all over Sarawak. Chieng Jen has 60 plus missed call and I have more than 20 calls from different person to entertain. What a encouragement to us.

Besides that, Chieng Jen and I won another case in Traffic Court today. We act for one Chong Siaw Teck who was the driver of a lorry. He was summoned by two traffic police by committing no offence. Chong Siaw Teck was acquitted at the end of the prosecution case.

Our defence was that there was no such offence committed. We contend that on that particular day, the police went to a construction site at Jalan Stapok tried to look for a site supervisor asking for bribe. At the end of the day, the site supervisor refused to see them. Thereafter led to the police's act of revenge to summon all the lorry went into the site. Four were summoned and three of them decided to fight against the corrupt act of the police.

Until today we manage to get 2 of them acquitted . Still left with another driver, Chai Joon Foo, his fate will be known on 7.10.2008.

Today is a justice prevailing day.

沈耀荣敢放弃用人联旗帜竞选吗？

我今日挑战人联青促请人联党联邦部长在内阁里动议废除内安法令并释放拉惹布特拉及兴权5位扣留者。
我是针对人联青今日呼吁政府废除内安法令做出回应。

我要人联青总团长沈耀荣表态如果政府没有在短时间内废除内安法令，是否会退出人联党，或本身不再以人联党及国阵的旗帜参与竞选？

人联青的该项呼吁是在对选民进行表演，没有任何的政治意愿要废除向来用以保护国阵的内安法令。
内安法令是国阵向来的权利保护工具。人联青没有任何一个领袖是部长级的人马，他们可以毫无顾虑地呼吁。但是人联党的部长们是否会持有同样的立场就是个疑问。

沈耀荣应该表明其政治决心，促请人联党联邦部长在内阁里动议废除内安法令，及拒绝以人联党及国阵的旗帜参与竞选直到内安法令废除为止。国阵的政治领袖应该学向前首相署部长再益依布拉新的态度，宁可辞职也不愿有名无实地执政。

扣留郭素沁，马来西亚会比较安全吗？
内安法令是国内安全法令的简称，是为了维持国内安全而设的。
郭素沁在内按法令下扣留，是因为第三者--前锋报的记者，评论雪州反对党领袖基尔的言论时，指责素沁发表了禁止回教堂用扩音器播放祈祷声。

那位前锋报记者真的是遥远的人（Remote Person）。他所说的话就这样无缘无故地套在素沁头上。素沁就这样去一个不是人住的地方，住上了一个礼拜。

素沁被释放了，从一个不该不自由身，成为自由身。
马来西亚是个法治国。有宪法国法管制，但没有宪法国法保障人身。可笑。
顿时想到念书时代时念的“法律哲学”科目，其中有一个法律界的辩论是，法律是不是必须合乎道德？

内安法令是剥夺人权的法律。有它的存在，我们的人身自由不可能被保障。就连记者也无法幸免。
没有道德的法律，不能合法。人身自由的保障是必须与赋予辩护机会肩并肩。

素沁被关一个星期，内安法没有给予她24小时内必须被释放，不然必须向法庭延长扣留或被控的权利。
试问人身自由的保障在那里？

扣留郭素沁，马来西亚有比较安全还是更人心惶惶？

不是全部马来同胞都是阿末

阿末依斯迈终于“出人头地”了，从默默无名的人物，变成全国瞩目的人物。他对国家的“贡献”，没有让人想册封他“拿督”勋衔，反而被槟州首席部长林冠英点名应该剥夺他的“拿督”勋衔。

他的“华人寄居论”，加上之后引发他党友发表的“记者应枪毙论”及撕裂前槟州首席部长许子根的肖像，这都十分戏剧化。夸张得不留余地。
他们是吃了豹子胆吗？这背后有否政治议程？

地点：
事件发生在槟城，火箭、民联执政州属，首相家乡，安华的政治跳板。

时间：
事件发生在916可能变天关键时刻。

人物：
事件是由巫统党员，从没什么听闻过的人，突然胆大包天，突然连首相都可以不理，突然言辞强烈，突然行为强悍。

后果：
不断高喊“马来人万岁”，企图挑起马来人及华人的不满情绪。这与国阵在峇东埔补选时所攻击安华的口号如出一辙，说安华是华社的工具。

这可能是陷阱。是要破坏308时的全民团结。国阵的政治议程是要分而治之，所以他们不愿，不要也不希望走出种族主义的框框。

别对你身边的马来同胞心怀怨恨，他们不全都是阿末。阿末没资格代表全部马来人。我们别跌入这政治陷阱。

924- The Judgment Day

The Court fixed 24th September 2008 as judgment day for Bandar Kuching Election Petition.

The Counsels were called for clarification of their submissions before the Judge this morning. The clarification session lasted for about 3 hours and the Judge annouced that on 24th September the decision will be delivered in open Court.

Chieng Jen's political fate will be decided by then. If the decision is made against him, he could have be vacated as MP for Bandar Kuching. If, assuming again, the Federal Government changes hand on 916, he could be the shortest serving Pakatan Federal Government MP in the history of Malaysia.

No one knows what will be happening in the very next seconds, what more to say on 916 and 924.

Indeed I should correct myself. Both 916 and 924 are Judgment days.

Finally, in Malaysian’s relief, Permatang Pauh electors strongly, vividly and ambiguously, rejected the racism, mismanagement and corruption of the Country under the governance of Barisan National. Permatang Pauh electors didn’t let us down. They spoke for us, through their crosses on ballot papers.

One may ask next, will there be 916?

I can’t see any way to change the country for better apart from changing the government. From what we can see in Permatang Pauh by-election, UMNO propagated further their racism by focusing the highlight spots at the distinction between Malays and non-Malays in this country. On the other hand, MCA used the national coffer to distribute money to the elector in the name of welfare fund. What a shame to MCA!

I really can’t see BN feels regretful after 308 heavy defeat. Pak Lah increased the petrol price by 78 cents to RM2.69 per litre (in Sarawak), while diesel price was increased by RM1.00 to RM2.58 per litre (in Sarawak) on 4th June 2008. Again, Pak Lah announced the reduce of petrol and diesel price by 15 cents and 8 cents respectively, few days before the Permatang Pauh by-election. This does not tend to show BN is regretful, and, most importantly, Permatang Pauh knows that!

Obviously, Permatang Pauh not only voted against fuel hike, but to the corrupted mechanism and racism thought of BN as a whole, that we had suffered enough for past 51 years. Permatang Pauh has a great vision and mission. BN is shaken by them. We should be proud of Permatang Pauh.

我在全国党员代表大会讲词

我在第15届民主行动党全国代表大会抨击回教党企图延续巫统的种族极端主义，而人民公正党则企图延续巫统的一党独大。我要求党中央领袖采取更果断及勇敢的方式阐明党的立场。

回教党不断的发表建立回教国的言论，这是不能容忍的言论。这是企图延续巫统种族主义的其中一个翅膀。无论回教党使用任何理由，我们绝对不能允许建立回教国。民主行动党是全国最有原则的政党，我们不能因为加入民联而失去党一路来的主张的原则。

我对近来回教党领袖的回教国言论感到遗憾及厌倦并谴责回教党狭义的政治观。民联的政策必须是全民性的政策没有民族及宗教色彩。

再来在议席分配上，我也抨击人民公正党处处逼人，企图延续巫统另一个翅膀，就是一党独大。公正党一直不断对民主行动党的传统堡垒区打主意。在砂拉越，火箭与公正党在过去308国选有很不愉快的“合作”经验。火箭在砂州只有攻打7个议席。而公正党砂州联委会主席黄锦和竟要我们让出议席，不然就全面开打。这怎么可能是一个盟友的作风？结果领袖们在最后决定不让出任何席位。公正党却在两个选区制造三角战，而公正党在这两个选区都失去按柜金。此外黄锦和更在泗里奎为独立人士站台，导致我们仅以51票落败。在砂拉越，我们不敢和公正党合作。”

我要求党中央领袖对盟友不可表现懦弱，以免我们失去我们原有的原则。

何时能尝六味汤的清甜？

安华为了寻求进入国会，打出四大招牌，“团结，经济，求变，治安”。
这四个很简单的词句，将触动众人的心弦。

就说团结。

马来西亚，这个多元种族的国家，注定是一个各民族互相张力的容器。各民族的张力，除了源自不同的传统，风俗习惯，生活环境，捍卫母语的情操，更免不了宗教教义上的差异。这是马来西亚，是我们的国家。我们不能因为其他人的不同，而漠视我们也有的共同点。我们须学习发掘各民族的共同点，不是凸显各民族的不同。与友族同胞共同相处在同一个社会容器里，是一门学问，也是一个挑战。

这个挑战，我相信在1963年的513事件以来，越来越艰难。巫统的分而治之的政治议程，在不断的凸显各民族的不同，使各民族的张力，越来越紧绷。国阵主张巫统治理巫裔，马华、民政、人联党治理华裔，国大党治理印裔。而国阵又是以巫统为主导，其它成员党又形同附属品。再来国阵的新经济政策，大学教育的种族政策，政府工程的种族政策，宣布大马为回教国等，都在阻止国民团结。

马来西亚有如一个盛了六味汤的容器，盛了不同的材料，理应互相辉映，形成美味的饮品。不该是分裂，没有统一的理想。

2001年美国的911事件后，有记者报导说，遭受恐怖袭击过后的美国人，开始更加团结及对别人更加友善。在乘搭地铁时，可以见到人们更有礼让精神。美国也曾有白人与黑人种族的张力。但是现在连黑皮肤的奥巴马都有可能成为白宫的首位黑总统，这是一大突破。我相信这是美国建国两百多年以来，民族间的张力是最为缓和的时刻。

很自然的当人们经历共同的委屈时，自然就会团结在一起，对抗外敌。如果政府没有平等的对待各民族，永远只有族群内的团结，没有族群间的团结。

安华的竞选口号是“马来西亚的新希望”。“马来西亚的新希望”不是在于安华本人，而是他所传递的政治理念。安华所讲的“团结”，是要摒弃巫统种族政治，这是令人鼓舞的。

巫统的种族政治，是被马华，民政，人联及其它国阵成员党纵坏了。巫统青年团举剑事件，直到今年308国选之后，才有人道歉。这是马华与民政惨败之后才有的力量，绝对不是因为马华与民政在国阵里协商的力量。我相信在州选方面，人联党如果惨败，那个力量肯定比人联党目前协商的力量更大。

巫统在峇东埔补选的竞选策略是指责安华是华社的工具，说他不会帮助巫裔族群。由此可见，巫统种族政治的手段仍然在广泛使用，使人民分裂。然而安华在峇东埔提名后，对记者说“我要对全民包括巫裔，华裔和印裔等，都实施公平的政策。”

火箭的槟城首席部长，林冠英，也曾在槟城州议会回应安华的对手，阿力夏，说他是全民的首席部长，他会公平对待各个族群。回教党的霹雳州州务大臣尼查也在执政100天时做出相同的承诺。

国民团结不是将教育及语言统一，将各族传统通化，更不是透过参与国民服务计划，乃是公平对待各民族。

李宗伟在奥运羽球男单半决赛击败韩国的李炫一时，亲吻衣服上的国旗，更拥抱他的巫裔教练，米士本。这是多么美的一幅画。我们本应该就是“同一个国家，同一个梦想”。

这里是马来西亚人的马来西亚。国阵何必执行种族政治，导致六味汤不再清甜？

回教坟场被挖掘，行动党展开调查“经手人”

昨早，健仁与我共赴位于火车路的回教坟场，因为听说那里的坟墓遭人挖掘。我们听后大为震惊。这国家到底怎么了，为了发展连回教坟场都不放过。那可是拥有百年历史的回教坟场。

我们到达目的地时，感到现场气氛有点紧绷。有浓烟冒起。事后才知道原来是家属因为宣泄不满，将发展商的“神手”焚烧起来。

那里充满群众的愤怒。
那不过是面积不大的地段，埋葬了近300位往生者，连这样一片土地也要发展，这政府是那根筋不对？我们在现场听说这地段将发展成公寓。众人纷纷想知道这是否属实。健仁向民众承诺，势必追根究底，查出掘坟黑手。

砂回教福利信託理事會称家属原已经同意搬迁，不知为何又演变成示威活动。
我们不知道是否有人曾经同意，更不知道有多少人同意，也不知道同意者清楚知道他们同意什么。我们知道以现场愤怒的气氛来看，不可能他们会同意。

这不是同意不同意的问题，这是原则问题。
为何百年坟场须让路给发展？砂拉越没有地了吗？要记得砂拉越可是面积最大的州属。

国阵政府的发展，有时真的让人闻风丧胆。

已经一个月又一个星期，健仁几乎天天呆在法庭，
面对左右自己未来命运的审讯。
他已经坐在证人栏里超过一个星期。
我们无法准确预测几时古晋选举诉讼案会完结，
所以健仁没有办法像我们倒数奥运一样，
倒数自己在证人栏的日子。
只听过他数数自己在证人栏已经第几天了。

安华与健仁，同是天涯沦落人，
须在法庭内度日如年。

不同的是，安华的助理指控他鸡奸，
健仁的助理没有。
庆幸。

伯拉执政成绩一落千丈

民意调查显示首相伯拉的表现满意度首次跌至不及格。这项民意调查是由独立的民调机构默迪卡中心（Merdeka Center）所制作的。默迪卡中心于上周发表的《2008年第二季度半岛选民民意调查》显示，高达54%受访者不满意阿都拉身为首相的表现，只有42%表示满意。

“当今大马”针对这民调询问伯拉，伯拉毫不在意的回应说，“没关系啦，这是政治人物的命运，有起有落。重要的是你在下台前做过了什么。”。

如果以福建话来翻译伯拉的回答（我相信来自槟城的他会一些基本的福建话），是这样说：“唔代志啦, 志勒是政治郎也命, 物起物洛” （没关系啦，这是政治人物的命，有起有落。）

很潇洒的一句话。有如武侠小说人物的潇洒，看透尘世，我行我素，悠哉闲哉。

很多马来西亚人原本不懂伯拉是谁，直到他成为我国第五任首相，我们身为马来西亚子民就有“义务”知道他是谁。他是我国最高执行领袖，我们没有借口可以不知道他。从他的公众责任（Public Responsibility）至个人责任(Private Responsibility)都与你我有一定的关联。

当伯拉说“唔代志啦”，他伤透了马来西亚人的心。伯拉成为首相的表现不及格，是全国的事，不是伯拉家的事，他怎么可以当它是小事。这是涉及他的公众责任，他怎么可以说没事？我不在意他的政途是否亨通，有起有落与否，我关心他是否领导马来西亚“去荷兰”。

可能伯拉对这样的民调感到伤心，所以故作坚强，说了这样潇洒的话。这样的回答只是从个人感觉为出发点，没有从公众感觉为出发点。伯拉觉得政途是很自然有起有落，所以没什么在意。但是他是否知道在他的领导下，我国的物价有起没有落，我们的生活有落没有起。

就是因为这些因素导致他的分数有落没有起。

UMNO is down to town, where is SUPP?

The Counsels of Chong Chieng Jen had successfully obtained an Order from the Election Judge on 11.07.2008 to compel the Petitioner, Kho Whai Phiaw, to deposit with the Registrar the sum of RM70,000.00 as additional security for costs on or before 22.07.2008.

Yesterday, the Petitioner did pay the said sum into Court and surprisingly the money is contributed by UMNO, a party without a single branch in Sarawak!

The Executive Secretary of Barisan Nasional, Datuk Yaacob bin Mohamed (PW10), testified that the UMNO is fully sponsoring Kho the amount of RM70,000.00.

The Bandar Kuching Election Petition, is originated from the astounding election held on the March 8, 2008, consisted a battle between Allan Sim Yaw Yen of SUPP with Chong of DAP in Bandar Kuching constituency. Instead of someone from SUPP files the Election Petition, an ordinary voter from Bandar Kuching constituency did that. A SUPP’s leader, Sih Hua Tong’s name was mentioned by PW2. PW2 testified that Sih asked him to come to the Court to give evidence.

To date, SUPP has yet to disclose the extent of their involvement and their role in this election petition. I challenged SUPP today in all local Chinese newspaper to state their stand. UMNO is openly in action at Bandar Kuching, is SUPP?

随着巫统执行秘书拿督耶谷已经在法庭上协助许怀标付还7万零吉的庭费，我今天在本地各大华文报挑战人联党表态他们在古晋选举诉讼案的涉及和立场。

从讼诉案审讯开始以来，人联党的彭大男及薛华东都相继出席聆听此案件的审讯。甚至此案的第二证人也曾指出是薛华东叫他出庭供证，人联党也因此与古晋选举诉讼案扯上关系。虽然如此，人联党至今还没表态他们在这宗案件所扮演的角色。

这宗诉讼案是原自人联党的沈耀荣与火箭的张健仁在今年3月8日的选举对决，之后变成一个选民起诉一个民选代议士。如今竟发展至巫统，一个在砂州没有任何支部的政党，也出面在经济上支援起诉者。人联党没有理由再完全保持沉默而不敢表态。

大马政治不能“复原”

从安华再次被捕，到获得警方保释，我感慨大马政治已经走入一个不可能“复原”的时刻。
我所指的“不能复原”是，不能像以往这样，枯燥无味。

前天跟一个新闻界的朋友闲聊，话题是“没有安华，会有连续下去的政治海啸吗？”
我不想把一个的人神化，毕竟人不过是人，有一定的有限，没有绝对的无限。

如果将一个政治人物神化，对国家未来的前景不是一件好事，特别是当那一个人掌握大权之时。
虽然我的想法是如此，我还是对那位新闻界的朋友说“我相信没有安华，会影响海啸的力度。”

当然，可能未来的历史将证明我是错的。
同胞们，无论如何，我们应该把焦点放在国家未来是否更加美好，不是是否改朝换代。
我们不能让期望使我们生存，也不能生存在憧憬里。
不然我们只拥有遥不可及的明天，却失去眼前的今天。
这也是我对砂州公正党谦卑的一席话。

大马政治不能“复原”，不是指由“好”变成“坏”。
国阵里一党独大的传统已经衍生到无可救药的地步。
连“现代包青天”都飞不上“青天”。
贪污，滥权，舞弊，朋党主义已经生根蒂固在国家系统。
或许不能“复原”是回到公平正义的原本。

如果真的改朝换代，我希望民主行动党能继续扮演制衡的角色，
制衡一党独大。

我要结婚了！

我将于来临的8月1日结婚了！

去年尾我与我的未婚妻，许玲彬，原本决定今年尾结婚。
我们认为这是人生大事，须费一年的时间来筹备。
也担心全国大选会落在今年年中，所以起初我们决定今年12月步上红地毯。
但是大选提早至3月就举行了，大选完了后，我俩也商议（注：不是人联与土保党的协商方式，只有土保党说，没有人联党说）将婚期提早至来临的8月1日。

我原本十分不愿意在这个部落格上载任何私人的东西，因为我认为应该善加利用这个空间讨论与公众利益有关的事情。我考虑了许久，认为我一生的人生大事，需要与你们分享。

这个社会真的需要认真看待婚姻的人，不然社会问题将衍生不断。
我从我的弟弟、弟媳及我们的婚前辅导员，郑女士，学到了以下简词义重之句：-

婚姻是一男一女，一夫一妻，一生一世。

我将这些语录写在这里，与你们共勉，也用以提醒自己。

原本以为婚期可以不和大选撞期，哪知竟然来个程咬金-古晋区选举诉讼案，令我分身乏术。
幸好未来的贤内助十分了解，也自行安排许多婚礼事项，让我有喘气的空间。
对她我感到愧疚，也感激不禁。
两对的父母亲的劳心劳力及经济支援，无以为报。
身边许多朋友，党内的同志也自动给予协助，异常感动。
一些报界的朋友也给予关心，受宠若惊。

在黑暗及污秽的政界打转，令我更觉得家人及真诚朋友的可贵。
这世界最缺乏及最需要的是真诚的爱，不是吗？

好久好久没有Blogging。古晋选区的选举诉讼案已经进入了第三个星期。
这案件扰乱了我们的正常作息。这工作量不假于竞选期的工作量。
所以Blogging 的胃口也消失了。
深感抱歉。

现在，我们几位律师团的成员在商讨案件。接近十点了。
每个面带倦容。不懂几时这烟霾会过去。
我不能评论太多关于案件，可能会被冠上藐视法庭的罪名。

行径霸道的"爱心政府"

<---左图是我昨日拜访甘密街菜市场时为四川及缅甸灾民筹款的情况.这筹款活动也受到甘密街印裔小贩踊跃支持。显示爱心超越国界及种族。

国阵政府竟然采用威胁手段欺压甘密街菜市场小贩。北市市政局近日在该菜市场竖立告示牌，恫言将控告6月15日不愿搬迁的小贩。政府以这样强硬的手段对待基层的人民，显示所谓国阵是爱心破产的政府。

我于昨天拜访甘密街菜市场，向该处小贩收集资料，以准备代表小贩们起诉南北市政局。北市在5月15日发出指令要甘密街全部小贩6月15日搬迁至实督东。张健仁承诺将义务代表这群小贩入禀高庭，起诉政府不合理的强迫甘密街小贩搬迁。这些小贩有者甚至家族几代以来在这里经营生意，一家的生计也是依靠这里的摊位维持。政府这样短促的指令显示政府重来没有从他们角度体恤他们。

目前只有十几个小贩已经呈上同意书给我们以支持将这起事件带上法庭。距离我们起先的目标40位，还有一段距离。我不排除北市威胁的举动让小贩们的之前的决心软化下来，小贩们因此被逼于无奈。无论如何决定权是在小贩的个人意愿，没有人可以强逼他们是否愿意入禀法庭。因为在法律的精神下，一个人拥有起诉他人的决定权，这也是人权。

我们将收集同意书的期限展延。将稍后以人数是否达至40人来决定是否入禀法庭。

垃圾对准小贩摊位，臭味搭配食物美味

肯雅兰夜市小贩中心小贩们投诉南市市政局没有提供理想的垃圾收集处，导致该小贩中心恶臭频频。该中心小贩将他们的不满向我反映。我夜间巡视该小贩中心后表示将为他们致函南市市政局做出正式投诉。
市政局所提供新的垃圾收集处出现三大问题：-
第一：垃圾收集处设立在小贩摊位隔邻，导致臭味直接影响小贩们的作业，也影响用餐客户。
第二：市政局将垃圾收集处的门上锁，导致人们将垃圾堆集在门口，加剧对该小贩中心的污染。
第三：该垃圾收集处的屋顶十分的底，使该处的有盖垃圾桶无法打开，垃圾被抛掷在垃圾桶外。

国阵政府一贯的作业手法是，在进行任何计划时，没有寻求受影响者的意见。有些小贩们在该小贩中心经营生意已经许多年，市政局应该在还没有设立该垃圾处前寻求他们的意见。

维持区域卫生是地方政府的职责。这职责甚至是法定的。南市市政局有必要尽快妥善处理垃圾收集处的问题，并添加该小贩中心的垃圾收集次数，还给该处小贩一个卫生的营业环境。

偷鸡不是偷汉

“阿仁加油”运动即将开跑。

健仁被禁足州议会事件，令党内许多同志为其打抱不平。
同志们觉得国阵这样的手段，是不尊重民选制度。
民选的议员，竟能因为勇敢在州议会批政，而被接受处分。
表面是因为批评议长而受到处分，但实际上不过是一个伎俩，
企图让反对声音销声匿迹。

同志们今天身穿党服，出席声援健仁的记者会。
我在记者会上揭开国阵通过2007年的特权法令，是具有背后政治企图。
特权法令的提呈通过，是因为砂06年520的政治改变所致。
520州选，在野党首次有7位（火箭6位，公正党1位）进入州议会。
国阵议员使用特权法令对付在野议员。
这不是公平的竞技。

健仁在第24条文下被判有罪，但却在第14条文下被罚。
第24条文的罪行所受的处罚，最高不过是罚款2,000零吉，
而第14条文才是被处于禁足议会。
试想想，一个人如果被控偷鸡，怎么可以当他是偷汉来处罚？

司马昭之心路人皆知。
国阵不要健仁罚钱，要他不见人影。
这样“白毛”先生之后一天的议会回答才不会受到攻击。

“阿仁加油“运动将有一系列的活动。
希望我们一起为捍卫民主而热烈相应。

国阵是什么不能见人？需要使计赶走健仁。

预料会有这么一天，健仁会成为2007年州议会特权法令下的牺牲者。
这天就这样来了。来得轰轰烈烈，来得气势如虹。
昨天早上健仁还对我说，“下午应该没什么”。
言下之意是叫我专心于昨天下午法庭的结案陈词。
结果，就是在那个下午，他被第一副首长及第二副首长动议在特权法令下被禁足于今年的州议会。
“罪名”是向报界批评议长的不公。

我接到消息，拨了电，揶揄了他。
电话筒的另一边传来了他无奈的笑声。

是，在这样不公的环境中，除了无奈，再也不能容纳多余的情感。
健仁5月7日的议会讲词里，只谈到“白毛”的名字而已，就被议长禁止继续发言。
我曾将当时议长及健仁的对话写在以下（My Dun’s Diary – 7.5.2008）。

议长不公的决定，不能受到批评。
这不民主的作法，是所谓民主社会该有的吗？

今天是“白毛”先生的议会回答。
此时健仁被赶走。
国阵议员必定直呼“好险！”。

What a May 13 day!

Chong Jin Ken was charged with 2 traffic counts on 17.07.2007. The police alleged him being guilty of driving a lorry carried with earth which was not covered properly.

His defence was that the police was demanding "kopi-o" from his site supervisor and the site supervisor refused to see him, and thereafter the summons was issued against him who heading towards the site.

One of the police did admitted to the Court, while cross-examined by Chieng Jen, that he did uttered the following words before issuing the summons:-
"Saya sudah pusing site beberapa kali, site supervisor tidak mahu keluar jumpa saya. Bagaimana menjadi site supervisor macam ini?"

Further, the police also admitted to the Court that these are the only words he uttered.

Chong Jin Ken has been acquitted by the Court this morning on the reason that the Prosecution had failed to establish the prima facie case.

What a May 13 day for Chong Jin Ken and Malaysian's justice at large.

My DUN's Diary - 7.5.2008

Mr. Speaker, have you heard about “Wikipedia”? (Silent) Anyone heard about “Wikipedia”? (Silent) That’s mean you are not very internet servy. It is a free encyclopedia available to anyone on the net. You can type anything, and most of the time you will get the answer. But in the “Wikipedia”, I will urge honourable members of this House to have a look. I went in, I do a few searches, and when I came along with the name of our Chief Minister, Abdul Taib Mhmud…

Speaker: No… No… I have to stop you.

Chieng Jen: Ha… (Laughing) Why?

Speaker: Because is sub-judice.

Chieng Jen: No, no. That is not sub-judice.

Speaker: It was stated in the (election) petition (against you).

Chieng Jen: What is in the petition?

Speaker: What you alleged against the CM and the family, and the companies.

Chieng Jen: What did I alleged?

Speaker: If in the election petition served on you by the petitioner with you as respondent, incited or with your blog and you pamphlets, so I have to stop you…. Member for Kota Sentosa, that is my ruling.

Chieng Jen: It is very bad…

My DUN's diary - 6.5.2008

Chieng Jen questioned the Deputy Chief Minister of Sarawak, Tan Sri George Chan, on the Government’s effort to ensure the equal treatment in entertaining police report from the public and high rank government officer. The question was posed to the government in this morning questionnaire sessions in Dewan Undangan Negeri (DUN) sitting.

In 25th March 2008, I had received a complaint from a Ling’s family at Tabuan Laru, Kuching that their house has been robbed in the very afternoon. They discovered the daylight robbery sometime at 2 pm. They called the police right after the discovery, but the reply given was that they have to go to the nearest police station to make a formal report, only by then the “Saya Anti Rasuah” team will send the man down to the scene for investigation. Ling’s family waited for an hour to complete the report making and waited for another few hours for the police to come. From the time they first discovered the crime until the arrival of the 2 investigating officers on the “welcoming red carpet” of the crime scene, it took 4-5 hours.

On 28th March 2008, similarly the BN Samariang Ahli Dewan Undangan Negeri’s (ADUN) house was robbed. She needed just a phone call to summons the police to come. Not only pitiful 2 officers came, but a group of investigating officers, lots of high rank police officers including the State Commissioner of Police came, and even police dogs were there to facilitate the investigation.

Same treatment to George on the robbery of his house on last April fool day.

I wondering what kind of phone was used by Samariang ADUN and George. For them, one phone call was good enough for the police to come. For Ling’s family or public at large, we got to go through lots procedures including making police reports and recording statement. It can be simple, but for whatever reason it has been made complicated and became extremely time consuming.

The question posed by Chieng Jen this morning to George was not well answered. George on the other hand called for suggestions to solve this problem. To me, this is a problem of double standard practiced by the police force. Can’t state government directs the police to treat public equally as what has been rendered to him? What more suggestion needed by him?

Unfortunately I was sitting in the public gallery to hear this kind of answer.

Even Mahathir has to go on Blog

I was one of the attendants of media forum organized by AZAM and See Hua Group held yesterday at Crown Tower

I was representing Chieng Jen to attend the forum entited "Challenges Posed by Alternative Media". The forum agenda forwarded to us shown nothing that Datuk Wong Soon Koh will be the guest of honours of the forum. In his opening speech, he emphasized that “credibility” should be the essential element leads towards the survival of mainstream media, such as daily newspapers. He also emphasized the importance of being an “investigative media”. He commented that alternative media is lacking of resources to become investigative, and it is why they are lacking of credibility.

I am totally disagreed with our Minister of Urban Development and Tourism of Sarawak. The hands of the mainstream media are most of the time tied. In Malaysia, we seriously in need of media freedom. Our Pak Lah, who claimed in desiring to hear the truth, is no one better than his predecessors of being a lover of media freedom. Even his immediate predecessor, Tun Mahatir, is forced to utilise the facility of the internet, sparing his peaceful retiring time to go on “blogging”. Tun Mahathir had commented that the mainstream media have been controlled by government and left with minimum room for media freedom. Tun Mahathir may never think of one day he has to sit down before a computer, joining blogging activity, which could be an alien to him while he was still the man in charge of this country.

The credibility of the mainstream media cannot be gained by way of becoming investigative media. To become ivestigative is a much more advance level for local mainstream media to achieve. We can’t even ensure the media freedom, what more to say moving into investigation work, which is overlapping the work of “Saya Anti Rasuah” team.

Indeed it is true for the mainstream media to gain more credibility in the eyes of the public in order to survive. However, this definitely cannot be done by way of becoming investigative but the government have to provide a freedom atmosphere for the media. Can you do that, BN Government?

Rampant mosquitoes in SR Chung Hua No.1, Kuching

Chieng Jen forwarded a mandarin SMS to me this afternoon, it read as follows in English:-

“Dear Mr. Chong,
I have 2 children studied in SR Chung Hua No.1. They were both seriously attacked by mosquitoes in school today, especially for those studied in classrooms nearby the jungle. The worrying part is that the denggi season is now approaching, isn’t the school should take more drastic action, to seek for solutions to overcome this problem. I hope Mr. Chong can help”

Chieng Jen is now at Kuala Lumpur for Parliament sitting. I am instructed to write on his behalf to DBKU to urge for immediate mosquito fogging work to be carried work in the school. We can’t afford to risk the student’s health, if not life. I am giving 2 days to DBKU starting from tomorrow.

My shocking day in Court

This morning while I was walking along Court’s corridor, rushing for my cases, I was informed that an Election Petition has been filed against Chong Chieng Jen at 8 this morning in High Court Kuching. From what I know, the Petitioner is a SNAP Member, based on the grounds unknown to me yet.

Chong had won 9,952 votes, a great majority, even in Sarawak history, bare in mind that there was no so called “opposition wind” in Sarawak. I met Ho Leng, our DAP State Chairman, this morning in Court, he told me that worries cure nothing. We have to fight this battle in full swing.

Yes, we got to fight against it, for the voters in Bandar Kuching, for the only people's voice from Sarawak.

希山道歉了吗？

这是那门子的道歉？希山为曾三度在巫青团大会上高举马来剑于昨日下午“道歉”。这所谓的“道歉”采用了国阵议员道歉时一贯用的字眼 --“如果”。

希山说“如果”举剑一事影响到任何人，特别是非马来人，他愿意作出道歉。

想当年有个人在国会拿女性的经期开玩笑，“一炮而红”。非但没有被受到纪律处分，现今还当上国阵后座议员副主席。他就是沙巴州Kinabatangan的国会议员，邦莫达。当年的他也是在各界的压力下做出类似这样“如果”式的道歉。

希山的“如果”式的道歉不是道歉。希山不过是在说“举剑没错，只是如果非马来人有负面的感受，我为这你们的负面感受感到抱歉。”

事实上希山没有为他举剑的举动道歉过。他如果有，他必然觉得举剑这是个错。这也是为何他没有承诺不再举剑。

他也没承认他举剑的举动造成了非马来人社会的伤害。他只是说“如果”有造成伤害，他愿意道歉。

所以马华青年团团长廖中莱，别这么快称赞希山的“勇敢”。人家都还没认错，何来道歉。他可能不过是说我们过度敏感而已。

人联党青年团，你们说是吗？

政治海啸，你为何不来砂州？

砂州公正党在2008年的第12届全国大选共竞选了12席。其中有2席与同样是砂在野党的民主行动党打对台，形成了3角战。这2个国会选区分别是实淡宾及诗巫。

翻开我国的选举历史，每当一个选区，无论是国会或州议会选区，一旦3角战或多角战形成，最终胜利的是国阵。所以当公正党在行动党所竞选的选区派员上阵，是等于协助国阵赢得该选区。

公正党在选战前已经深知他们如果在行动党这次所竞选的7个选区里，一意孤行插上一脚，公正党决不能取胜。选举成绩出炉时，公正党诗巫候选人林政全竟然对自己所得到的区区812票感到满意，他还说自己的预算不过是500张的得票。既然如此，公正党派林政全上阵的目的是为了什么？

公正党实淡宾及诗巫的候选人双双痛失按柜金。公正党在这2个选区仅得区区2,198及812张票，反观行动党在这2区得票为18,896及15,903张票。从2党得票的巨大差距来衡量，我不能相信砂州公正党领袖们选前没有这样一丁点的政治智慧及判断力。去分析他们在这两个选区的胜算有多少。公正党砂州领袖明明知道在这两个选区行动党的胜算是遥遥领先，为什么还要执意上阵，让国阵渔翁得利？

公正党砂州主席黄锦河竞选时把选民集会变成私人恩怨的“爆料会”，枪口对着行动党攻击。不仅如此，黄锦河还去到泗里奎为独立人士龚晶晶站台，大数行动党的不是。在竞选期间，他要选民听听他发牢骚，听听他的私人委屈。那么广大人民的委屈呢？选举不是政党之间恩怨的了决，而是人民对政客的裁决。黄锦河不该在公正党没有出战的选区，削弱行动党的胜算，他不该借选民集会攻击同是在野党的行动党。

从这次选举成绩来看，我们可以知道公正党在华人占多数的选区里不但没有增值的空间，也不被普遍选民接受。实淡宾及诗巫国会选区分别占有79.3%及48.6%的华裔选民，但是公正党都在这两个选区失去按柜金。除了老越国会选区外，公正党在其他所竞选的9个选区都没有失去按柜金。

就算公正党派出华裔竞选土著占多数的选区，也能交出不错的成绩单。在实务地国会选区，土著选民占了约76%，华裔仅占了21.5%，而公正党的张友庆也得了35%巴仙的选票。公正党应该把林政全及施志豪派至其他土著或混合选区，可能成绩将截然不同。

砂州不能像西马一样形成政治海啸，主要原因有二：第一、黄锦河在讲台破坏行动党领袖的形象，令许多选民对政治的自相残杀感到厌恶，而影响在野党票源。其二、公正党没有好好使用他们在土著区的优势，将候选人派到土著区占多数的混合区去，反而放到行动党胜算较高的华人区去，导致三角战形成。

黄锦河应该为这次公正党候选人安排的失误，负起全部的责任。来届的州选，黄锦河不该再一意孤行。欲形成砂州政治海啸，公正党及行动党须各尽其责。鉴于这次国选的成绩。公正党应该在来届州选专注土著区，才能与行动党携手否决砂国阵的3份2议席，粉碎土保党的霸权，并为取代国阵执政铺路。
